Petitioner, already in custody, seeks bail in connection with Madhuban P.S. Case No.330 of 2017, registered under Section 414 of the Indian Penal Code as well as under Sections 25(1-b)a, 26 of the Arms Act.

Allegation in brief is that the petitioner was apprehended and found in possession of a country made pistol, two live cartridges with one suspected stolen motorcycle. Learned counsel for the petitioner submits that the motorcycle was purchased by the petitioner but concedes that in the owner book the name has not been changed and the petitioner is in custody since 23.12.2017, however learned counsel for the State submits that this petitioner has got three

Having considered the recovery of arms and the criminal antecedents, the prayer of bail of the petitioner is rejected in connection with Madhuban P.S. Case No.330 of 2017 pending in the court of learned 4th Additional Chief Judicial Magistrate, Motihari, East Champaran.
