Petitioner seeks bail in Tariyani P.S.Case No. 37 of 2008 registered for the offences punishable under Sections 147, 148, 149, 323, 341, 302, 380 of the Indian Penal Code and Section 27 of the Arms Act and 17 of the CLA Act. It is a case of misuse of privilege of bail. Petitioner was granted bail vide order dated 04.10.2012 in B.P.No. 996 of 2012 and thereafter he did not appear in the court below at the time of framing of charge and as such his bail bond was cancelled. On 18.10.2019 he was declared absconder. Again he was apprehended on 12.04.2021 and taken into custody. Learned APP for the State has opposed the prayer for

Patna High Court CR. MISC. No.59386 of 2021(2) dt.08-02-2022 2/2 bail of the petitioner.

Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail and accordingly, his prayer for bail in connection with Session Trail no.119 of 2016 arising out of Tariyani P.S.Case No. 37 of 2008, pending in the court of Session Judge, Sheohar stands rejected.
