The petitioner apprehends his arrest in connection with Chakai P.S. Case No.23 of 2007 registered under Sections 147, 148, 323 and 386 of the Indian Penal Code besides Section 17 of the C.L.A. Act.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner came in the confessional statement of the co-accused, Manoj Marandi and Birulal Marandi. Except that, there is nothing to connect the petitioner in the commission of the
Patna High Court Cr.Misc. No.43423 of 2015 (2) dt.14-10-2015 2/2 alleged offence. It is also submitted that, in fact, the petitioner was residing outside the State to earn his livelihood and when he came to his house, then he came to know about the present case and prior to that, the petitioner had no knowledge regarding the present case.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, Judicial Magistrate, First Class, Jamui, in connection with Chakai P.S. Case No.23 of 2007, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U
