2. The petitioner is seeking regular bail in connection with Bhimnagar P.S. Case No. 08 of 2024 for the offences punishable under Sections 8(c) and 21(b) of the NDPS Act.

3. As per allegation, on a secret information, the informant along with S.S.B. team reached the place of occurrence. The petitioner tried to flee away after seeing the S.S.B. team, but he was apprehended. On search, 17.82 grams of brown sugar like substance was recovered from the possession of the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered

Patna High Court CR. MISC. No.55129 of 2024(2) dt.14-08-2024 2/2 from possession of the petitioner. The petitioner is a person of clean antecedent and is under custody since 06.04.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS, Supaul in connection with Bhimnagar P.S. Case No. 08 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) Before accepting the bail bond, the criminal antecedent of the petitioner shall be verified from the Superintendent of Police, Supaul and if it is found that he is involved in any other case, his bail bond shall not be accepted.
