JUSTICE SUDHIR SINGH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 18.05.2015 in connection with Jamui P.S. Case No. 295 of 2014 for the offences instituted under Sections 392/34 of the IPC. The prosecution story, in brief, is that on 21.11.2014 at about 5.00 P.M., the informant alongwith Ranjit Kumar proceeded from Nawada to his village-Khairma by his T.V.S. Motorcycle bearing No. BR No. 46C/8954 at about 7.30 P.M. when the informant reached near Khargour More, three unknown criminals who were ridding on the Motorcycle stopped him and at the point of knife, criminal snatched Rs. 1300/- and mobile of the informant bearing No. 8235248195 and thereafter also his motorcycle was

Patna High Court Cr.Misc. No.43506 of 2015 (3) dt.10-11-2015 2/2 snatched and accused persons fled away, taking his motorcycle. Accordingly, the case was lodged.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.05.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering of the evidence against the petitioner. The petitioner is not named in the FIR. The name of the petitioner has come in course of investigation. No TIP has been conducted to ascertain the involvement of the petitioner.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jamui, in connection with Jamui P.S. Case No. 295/2014(G.R. No. 2012/2014).
