The petitioner seeks bail in Darihat P.S. Case no. 40/2015, registered for the offences punishable under Section 392 of the Indian Penal Code.

The petitioner is not named in the FIR. The name of the petitioner figured in the case in the confessional statement of Monu Kumar from whose possession looted mobile was recovered.

It is submitted that one looted mobile is said to have been recovered from the possession of the petitioner also but true fact is that no looted mobile was recovered from the possession of the petitioner. At the instance of Monu Kumar the petitioner has been implicated in this case. Monu Kumar has already been enlarged on

Patna High Court Cr.Misc. No.43568 of 2015 (2) dt.21-09-2015 2/2 bail vide order passed in Cr. Misc. No. 36903 of 2015. The case of the petitioner stands on the same footing. The petitioner is in jail since 30.06.2015.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Divesh Kumar, Judicial Magistrate 1st Class, Dehri-on-Sone, Rohtas in connection with Darihat P.S. Case no. 40/2015.
