A supplementary affidavit to that effect has been filed.
Heard learned counsels for the petitioners and the State.
The petitioners are apprehending arrest in a case
Patna High Court Cr.Misc. No.44319 of 2015 (2) dt.30-09-2015 2/3 registered for the offences punishable under Sections 147, 148, 149, 188, 353, 332, 323, 337, 338 of the Indian Penal Code and section 27 of the Arms Act.
The prosecution case is that during PACs elections, supporters of two contesting candidates were quarreling when the informant being the police officer tried to pacify the matter, the accused persons pelted bricks and made assault with 'lathi'. The accused persons also fired in the air.
It is submitted by learned counsel for the petitioners that accusation is omnibus and general and petitioner no.1 is 75 years of age. It is further submitted that the injuries of the injured have been found to be simple in nature.
Considering the accusation against the mob and statement being made in paragraph 3 of the petition that the petitioners have no criminal antecedent except petitioner no.1, who is accused in another case being Simiri P.S. Case No.221 of 2014, wherein the police have submitted final form, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Simri
