The petitioner seeks bail in Paharpur P.S. Case No. 47/2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named the petitioner along with other accused persons and alleged that a quarrel took place between his children and the children of Ramji Prasad and Ramashish Prasad (Petitioner). On such, other accused persons having armed with lathi brutally assaulted the wife of the informant. It is submitted that the wife of the informant got one lacerated wound on the right side of neck measuring 1"x 1⁄2". On account of haematoma, the wife of the deceased died. There is no

It is further submitted that there is a counter version and similarly situated co-accused persons have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 43976/2014. During the pendency of anticipatory bail petition, the petitioner was apprehended and that is why he withdrew his anticipatory bail. The petitioner is in jail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 13th Additional District Judge, East Champaran at Motihari, in connection with Paharpur P.S. Case No. 47/2014.
