Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 325, 307 and 326 of the Indian Penal Code. The FIR would reveal that the specific allegation of commission of fracture injury and cut injury is against co-accused Shajahan. There is general and omnibus allegation against the petitioner of commission of assault. The petitioner's side had also sustained injury, which revealed during course of investigation.
Learned counsel for the informant opposed the prayer for bail on the ground that the petitioner has got criminal antecedent, which would be evident from the
Patna High Court Cr.Misc. No.5181 of 2018 (2) dt.31-01-2018 impugned order.
Since no specific allegation is there against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sultanganj Police Station Case No.385 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
