This application for anticipatory bail arises out of Nawkothi P.S. Case No.83 of 2018, disclosing the offences under Sections 147, 148, 149, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. There is apparent typographical error in the prayer portion of the application, in which, 'Nawkothi P.S. Case No. 51 of 2019' has been typed in place of 'Nawkothi P.S. Case No. 83 of 2018'. Since the typographical error is apparent, the same is ignored.

Learned counsel appearing on behalf of the petitioner submits that co-accused Neeraj Singh has already been allowed regular bail by this Court by an order dated 25.04.2019 passed in Cr. Misc. 27211 of 2019.

As per the case of the prosecution, Neeraj Singh had

Patna High Court CR. MISC. No.46172 of 2019(4) dt.16-11-2019 2/2 opened fire causing injury on the person of the informant. There is allegation against the petitioner also of having opened fire, but the shot did not hit the informant, as per the case of the prosecution. Considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of Sri Raghuveer Prasad, learned Judicial Magistrate, 1st Class, Begusarai, in connection with Nawkothi P.S. Case No.83 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
