====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 06-07-2021 Heard the parties in virtual Court.
The petitioner is languishing in custody for the offence punishable under Sections 354(D) and 376(D) of the Indian Penal Code and Sections 4 and 6 of the POCSO Act. The F.I.R. discloses that the informant is victim of gang rape. The petitioner was one of the party to the gang rape. Learned counsel for the petitioner submits that there is delay of 14 days in lodging of the F.I.R. and subsequently the parties have entered into a compromise.
The victim is consistent in making allegation in her statement under Section 164 Cr.P.C.
Considering the seriousness of allegation against the petitioner, I am not inclined to enlarge him on bail in connection
Patna High Court CR. MISC. No.5423 of 2021(5) dt.06-07-2021 2/2 with Jale P.S. Case No. 58 of 2020.
Hence, prayer is refused.
