The petitioner is in custody in a case registered under Sections 366(A)/34 of the Indian Penal Code.
The allegation against the petitioner and other coaccused is of kidnapping the daughter of the informant for the purpose of marriage.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 3.7.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. The main allegation is against one Rahul Kumar, who is said to have abducted the victim for the purpose of
Patna High Court Cr.Misc. No.43897 of 2015 (3) dt.16-10-2015 2/2 marriage with the victim and they are residing together. Same is evident from Annexure 2 to the supplementary affidavit. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., West Champaran at Bettiah in Bettiah(T) P.S.Case No. 391 of 2015.
