ANJANA MISHRA ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Biraul P.S. Case No.94 of 2019 for allegedly having committed the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were from the motorcycle which was standing in front of the house of the petitioner. Considering the fact that the petitioner has not involved in any offence of similar nature and there was no recovery from his conscious possession, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date
