JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-02-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 366A of the Indian Penal Code.

As per the prosecution case, this petitioner kidnapped minor daughter of the informant with a view to marry her. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Medical Board has assessed the age of the victim to be 18 to 19 years and the doctor has not found sign of rape on the body of the vicim. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 13.9.2020.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.59350 of 2021(2) dt.07-02-2022 2/2 bail and submits that the victim in her 164 Cr.P.C. statement has alleged that the petitioner forcibly took her away and committed sexual assault on her. Charge has also been framed under section 376 IPC.

Considering the nature of accusation against the petitioner and 164 Cr. P. C. statement of the victim, his prayer for bail is refused.
