2. The petitioner seeks bail in connection with Chanpatiya P.S. Case No. 747 of 2023 registered for the offence under Sections 392, 395 and 412 of the Indian Penal Code.

3. As per allegation in the FIR, accused persons stopped the informant's driver while returning from unloading sugarcane from Ramnagar Mill and took away the driver's mobile phone and informant's tractor and trolley bearing registration no.BR22GA-8605 which was driven by the informant's driver.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in

Patna High Court CR. MISC. No.54040 of 2024(2) dt.02-08-2024 2/2 this case and petitioner is not named in the FIR rather his name has figured on the basis confessional statement of co-accused Bittu Kumar @ Bittu Paswan. Petitioner is in custody since 16.05.2024.

5. Learned APP appearing for the State, opposes the prayer for bail of the petitioner.

Considering the facts and circumstances and submissions made on behalf of the petitioner that similarly situated co-accused person namely Bittu Kumar @ Bittu Paswan has been granted bail by this Court in Cr. Misc. No. 38268 of 2024 vide order dated 23.05.2024, let the petitioner, above named, is directed to be released on bail in connection with Chanpatiya P.S. Case No. 747 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st, Class, West Champaran at Bettiah.
