Petitioner is accused in connection with Warsaliganj P.S. Case No. 182 of 2016 registered under Sections 302, 201 and 120B of the I.P.C.
Submission of learned counsel for the petitioner is that earlier prayer of the petitioner for bail was rejected by this Court on 03.04.2019 vide Cr. Misc. No. 10350 of 2019 with observation that the Trial Court is directed to conclude the trial within a period of three months. If the trial is not concluded within the aforesaid period, the petitioner may renew his prayer for bail after three months. Now, three months has already been elapsed. Petitioner is in custody since 03.10.2016. Further
Patna High Court CR. MISC. No.47324 of 2019(6) dt.06-11-2019 2/2 submission is that on perusal of report of the Additional District and Sessions Judge-I, Nawada, it appears that two seizure list witnesses are yet to be examined and the next date is fixed for the evidence.
Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Nawada in connection with Sessions Trial No. 589 of 2016/744 of 2016 arising out of Warsaliganj P.S.
