Petitioners are named in the First Information Report but informant is not an eye-witness of the alleged occurrence nor any person has claimed to have seen the actual killing of the deceased. The names of petitioners have been given in this case on the ground that husband of the deceased had solemnized his second marriage with one Sangeeta Kumari, who happens to be the niece of petitioner no. 1, and petitioner no. 2 happens to be a co-villager of petitioner no. 1.

The contention on behalf of the petitioners is that except suspicion, there is nothing against the petitioners, who are

No.44929 of 2015 (3) dt.01-02-2016 2/2 languishing in jail custody since 24.07.2015, although learned counsel for the informant opposed the prayer for bail on the ground that in course of investigation, the Investigating Officer collected circumstantial evidence against the petitioners but taking into consideration the above stated facts and circumstances of the case as well as submissions of the parties, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Uma Shankar, J.M. 1st Class, Sikarahana at Dhaka, East Champaran in connection with Chiraiya P.S. Case No. 156/2015.
