Petitioner, already in custody, seeks bail in connection with Daudpur P.S. Case No.232 of 2017, registered under Sections 147, 148, 149, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code.

Allegation in brief is that this petitioner and one Prithvinath Rai assaulted over the head and other parts of the body of the informant's father.

Learned counsel for the petitioner submits that the allegation of assault over the head is on two accused, this petitioner and one Prithvinath Rai, however as per the postmortem report, only one lacerated wound was found over the head of the deceased and the petitioner is 94 years old man.

No.21194 of 2018(2) dt.13-04-2018 2/2 Having considered the aforesaid facts and circumstances and considering the age of the petitioner as well as allegation of assault on the head of the deceased is on two persons, petitioner Birandra Rai @ Birendra Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Chapra in connection with Daudpur P.S. Case No.232 of 2017.
