2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 120 ( B ), 302 and 34 of the Indian Penal Code.
3. As per the prosecution case , petitioner is alleged to be the director of the Bhojpur Health Care where wife of the informant died due to negligence committed by the other coaccused persons.
4. It is submitted on behalf of the petitioner that there is no allegation against this petitioner that he operated upon the wife of the informant. Petitioner is neither the director nor an employee of the alleged nursing home . He is only owner of the
Patna High Court CR. MISC. No.50361 of 2023(4) dt.01-11-2023 2/2 land of the alleged nursing home in question and has got no concern with the treatment of the wife of the informant. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Bhojpur at Ara in connection with Ara Nawada P.S. case No. 373 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
