The petitioner has prayed for bail in a case registered for the offence punishable under sections 25(1-b) a 26 of the Arms Act.

Prosecution case relates to recovery of one country made pistol and two live cartridges from the bag of the petitioner, by the police and on asking, petitioner could not produce any valid paper, then the present FIR. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has been falsely implicated in this case due to his six criminal antecedents. In fact, he was returning after attending a shradh ceremony and on the way he was arrested by the police showing false recovery from his

Patna High Court CR. MISC. No.49677 of 2022(3) dt.16-01-2023 2/2 possession. Petitioner is languishing in judicial custody since 01.04.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Pupri, Sitamarhi in connection with Bela P.S. Case No. 75 of 2022.
