2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 3(1)(2)(a) 4(1) of the Immoral Traffic (prevention) Act 1956.
3. Petitioner is alleged to be the owner of the restaurant in question where some persons were found in objectionable conditions.
4. It is submitted on behalf of the petitioner that he has falsely been implicated in this case merely because he happens to be the owner of the restaurant in question . On the alleged date and time of occurrence , petitioner was not present
Patna High Court CR. MISC. No.50544 of 2023(3) dt.01-11-2023 2/2 at the spot and he has got no concern with the alleged occurrence and without his knowledge and consent the alleged offence was committed by other accused persons. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C . J . M. Bhabua (Kaimur) in connection with Bhabua P.S. case No. 566 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
