The petitioner seeks bail in Baghaila P.S. Case No. 13/2019, instituted for offence under Section(s) 302, 34 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is no allegation of specific overt act against this petitioner in the written report.

It is alleged that on the date of occurrence at about 8 P.M. son of informant had gone with this petitioner and other accused persons as named in the written report, but he did not return. Later on dead body of son of informant was recovered from the house of co-accused Tega Ram.

Besides last seen, there is no other allegation against

Petitioner is in custody since 18.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Baghaila P.S.
