The petitioner is in judicial custody in connection with Sessions Trial No.36 of 2019 arising out of Jehanabad Mahila P.S. Case No.16 of 2012 registered under Section 417, 366(A)/34 of the Indian Penal Code.

Allegation against the petitioner was of kidnapping the informant's daughter Babita Kumari with an ill motive along with other accused persons.

The FIR dates back to 2012 and it was only on 01.03.2021 (as stated in para-17) that the petitioner came into judicial custody. The Trial is already going on and witnesses are being examined as the learned counsel for the petitioner himself concedes.

In the aforesaid facts and circumstances, when the petitioner evaded the law of the land for such long years, he

Patna High Court CR. MISC. No.59210 of 2021(2) dt.13-04-2022 2/2 does not deserve bail for the present, which is accordingly rejected.

The Trial court is directed to conclude the trial expeditiously in view of the fact that the matter dates back to the year 2012.
