The petitioner seeks bail in a case registered for the offences punishable under Section 376 and other Sections of the Indian Penal Code.

The victim made allegation that the petitioner on the pretext of marriage established physical relationship with her, but later on the marriage was solemnized.

It is submitted that earlier the petitioner was refused to marry with the petitioner and for that the prosecutrix filed this case. Now marriage has already been solemnized. The victim is a major girl aged about 23 years.

Considering the facts aforesaid and the fact that the marriage has already been solemnized, the petitioner above named

Patna High Court Cr.Misc. No.44640 of 2015 (2) dt.29-09-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cumSpecial Judge, Katihar in Dandkhora P.S.
