The petitioner has filed this writ petition for revocation of his suspension, as contained in memo No. 581 & 582, dated 13.05.2015, issued under the signature of Director. The petitioner was suspended on 13.05.2015 and departmental proceeding was initiated against him. The Additional Collector was made enquiry officer. The enquiry officer submitted
Patna High Court CWJC No.7373 of 2017 (2) dt.05-09-2017 2/2 his report to the Directorate of Economics and Statistics, Government of Bihar, Patna but till date no order has been passed on the enquiry report and the petitioner is still under suspension. Having considered the fact that the petitioner is under suspension for more than two years, the disciplinary authority is directed to pass order on the enquiry report of the enquiry officer within two months from the date of receipt of this order and if the disciplinary authority fails to pass order on the enquiry report the order of suspension of petitioner shall be revoked immediately after two months from the date of receipt of this order.
With this observation, this writ petition is disposed of.
