The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 498(A)/304(B) of the Indian Penal Code.

The allegation against the petitioner is to cause death of daughter of the informant, due to cruelty and non fulfillment of dowry demand.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. Petitioner is brother-in-law of the deceased due to which he has falsely been made accused in this present case. He

No.49444 of 2022(3) dt.19-01-2023 2/2 has no concern mess and business of the deceased as well as with her husband and the main responsibility to keep his wife with dignity and honour is against husband of the deceased, who is already in judicial custody. Similarly situated co-accused namely Doli Devi has already been granted bail by a coordinate bench of this court vide order dated 12.12.2022 in Cr. Misc. No. 43788 of 2022. It is further submitted that the petitioner is languishing in judicial custody since 14.8.2021. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Madhepura P.S. Case No. 437 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura.
