The petitioner seeks bail in Buxar Nagar P.S. Case No. 190 of 2017 registered under Sections 25(1-b)a and 26 of the Arms Act.
One country made pistol and two live cartridges are said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. As a matter of fact, the petitioner was apprehended by the police from jail gate while he was released and he was remanded in this case after five days. Patna High Court Cr.Misc. No.9907 of 2018 (2) dt.21-02-2018 2/2 15.04.2017.
Earlier bail prayer of the petitioner was rejected by this Court vide order dated 13.07.2017 with direction to the learned lower court to conclude the trial within six months from the date of receipt/production of a copy of this order, but the trial has yet not been concluded.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Buxar Nagar P.S. Case No. 190 of 2017.
