JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks bail in Punpun P.S. Case No. 145/2020 registered for the offences punishable under Sections 302/120(B)/34 of the Indian Penal Code.

As per the prosecution case, co-accused Dhirendra Yadav shot the nephew of the informant in his head as a result of which he died. It is further alleged that all the F.I.R. named accused persons after hatching conspiracy killed the nephew of the informant due to old enmity and litigation between the parties.

It is submitted on behalf of the petitioner that the petitioner is not named in the F.I.R., but subsequently, on the

No.4916 of 2021(2) dt.25-03-2021 2/3 basis of the confessional statement made before the police by co-accused Dhiraj Kumar, the name of this petitioner has been dragged into the present case which has no evidentiary value. Chargesheet has already been submitted in this case. Petitioner has got no criminal antecedent and he is in custody since 20.06.2020.

Considering the fact that petitioner is not named in the F.I.R., coupled with the fact that he bears clean antecedent, the bail petition of the petitioner is allowed. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned J.M. 1st Class, Masaurhi, Patna, in connection with Punpun P.S. Case No. 145/2020, subject to following conditions:- (1)Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court on his absence on two consecutive dates without sufficient reason, his bail-bonds shall be cancelled by the Court below.
