The petitioner has preferred this application for grant of regular bail in a case registered against unknown under section 392 of the Indian Penal Code.
As per allegation in the F.I.R., two persons on a motorcycle looted the informant of cash of Rs.15,000/ besides other articles.
It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. In course of investigation, the name of one Noor Hasan transpired in the confessional statement of one Md. Zafar and it was in the confessional statement of Noor Hasan made before police that the name of the petitioner transpired. No incriminating article
Patna High Court CR. MISC. No.10129 of 2021(3) dt.29-07-2021 2/2 has been recovered from the petitioner's possession who is in custody since 15.2.2020 and has no criminal antecedent. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for 1 year 4 months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Palasi P.S. Case no.11 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st , Araria.
