The petitioner has filed the instant application for grant of regular bail in connection with Kishanpur P.S. Case no.210 of 2016 registered under section 307 and other sections of the Indian Penal Code and section 27 of the Arms Act. As per the allegation in the F.I.R., it is stated by the informant that on the orders of Surya Narayan Yadav, the petitioner fired which hit on the head of his son. Others also fired.
It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and concocted. The petitioner has been falsely implicated in the case. The differences and dispute between the parties have been settled. The injury of Satan Kumar Sah has been found to be
Patna High Court CR. MISC. No.5305 of 2021(4) dt.27-07-2021 2/2 simple in nature. The petitioner is in custody since 27.6.2020 and has no criminal antecedent.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration that the injury on Satan Kumar Sah has been found to be simple in nature together with the petitioner being in custody for over 1 year, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Kishanpur P.S. Case No.210 of 2016 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul.
