High School to Pokhar

2. A counter affidavit has been filed by the respondent specifically pointing out that the raising of the level of existing road was necessitated only since it had become very low. The houses situated on the roadside were hence at higher level and there was water logging on the road. Though, the road level has been raised, it has been done in a manner ensuring that rain water does enter the houses of the house owners situated on the road side.

3. Reckoning the contentions taken in the affidavit, we are of the opinion that the public interest litigation need not be kept pending. We close the writ petition as unnecessary.
