JUSTICE ARUN KUMAR ORAL ORDER 20-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Halsi PS Case No. 93 of 2017 registered under Sections 387, 307, 153, 153A and 120B of the IPC.

The allegation in brief is that the informant apprehended that some contract killers were engaged by one Ranjit Vishwakarma to eliminate him, he informed the police and some persons were apprehended Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, only material which transpired against him is disclosure of his name by one co-accused Sunil Yadav in his confessional statement that he too was present and the tower location of his mobile he was found in that area, except that there is no other material, he has clean antecedent and similarly situated co-accused Chandan Kumar was earlier admitted to bail by a coordinate Bench of this Court.

Having considered the said facts and circumstances, the petitioner, namely, Nitish Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Lakhisarai in connection with Halsi PS Case No. 93 of 2017.
