The petitioner is accused in connection with Tajpur P.S. Case No. 383 of 2016, registered under Sections 30(a) and 47 of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving secret information about making supply of India made foreign liquor from Jharkhand to Kamlesh Singh at village-Motipur, P.S. Tajpur, District-Samastipur by Manoj Yadav (Petitioner), the informant being the Police official reached at Bhindchour, where one Truck bearing its Reg. No. JH-02P-4669 and a magic vehicle bearing No. BR-01PE-8330, were found standing, but none was present in both vehicles. On search, 1992 liters of India made

Learned counsel for the petitioner submits that it would appear from the F.I.R. that except the suspicion, no material has been collected against the petitioner to show that the alleged liquor recovered from the said vehicles was being supplied by this petitioner. Further submission is that petitioner is accused in two other cases as detailed in para 3 of the petition, due to that reasons, he has falsely been implicated in this case mere on suspicion. The petitioner is in custody since 09.11.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-III-cum-Special Judge (Excise), Samastipur in connection with Tajpur P.S. Case No. 383 of 2016.
