2. Petitioner apprehends arrest in a case registered for the offence punishable under section 115 ( 2 ), 126, 351 ( 2 ), 352, 303 ( 2 ) and 74 of BNS.
3 . As per the prosecution case , on the alleged date and time of occurrence , this petitioner assaulted on head of informant with sword due to which he sustained injury . Doctor has found the injury grievous in nature .
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to ulterior motive . Allegation of assault is general and
Patna High Court CR. MISC. No.49789 of 2025(2) dt.20-08-2025 2/2 omnibus against him. It is further submitted that the injury report was procured from private hospital. There is no reptition of blow against this petitioner.
5 . Learned counsel for the State opposed the bail and submitted that petitioner is named in the F.I.R. and there is specific accusation of assault with sword on the head of informant due to which he sustained grievous injury . Petitioner has got 2 criminal antecedents.
6. Considering the nature of injury , criminal antecedents of this petitioner and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
