Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 413, 414, 120(B)/34 of the Indian Penal Code.
The FIR of the theft of motorcycle is against unknown.
Submission is that the petitioner is in custody since 08.11.2017. However, he was never put on T.I.Parade nor anything has been recovered from his possession. Petitioner was simply remanded from some other case on the basis of confessional statement of co-accused. The investigation is complete and the petitioner is ready to cooperate with the trial.
Patna High Court Cr.Misc. No.11194 of 2018 (2) dt.27-02-2018 Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T.No.07 of 2018 arising out of K.Hat P.S.Case No.469 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
