The instance application for regular bail has been filed by the petitioner in connection with Palasi P.S. Case No. 91 of 2022 instituted for the offence u/s 363, 366/34 of the Indian Penal Code.

Earlier the application for regular bail of the petitioner was rejected by order dated 02.01.2023 passed in Cr. Misc. No. 50975 of 2022 alonwith Cr. Misc. No. 33993 of 2022 with an observation that the learned Trial Court is directed to expedite the trial and conclude the trial within a period of 6 months with a liberty to new his prayer for bail, if the trial is not concluded within six months.

Patna High Court CR. MISC. No.52242 of 2023(5) dt.01-12-2023 2/3 In pursuance to the direction of this Court, a report with regard to the present stage of trial has been received by which it appears that the trial may be concluded within six months.

It appears from perusal of Supplementary Affidavit that sister of the informant in her deposition has specifically stated that the petitioner has not taken her from home rather she on her own sweet will has left the home due to quarrel between her father and mother. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, deposition before Court as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Palasi P.S. Case No. 91 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned concerned court, Araria.
