Arif(APP) ====================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE ORAL ORDER 15-10-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accusedpetitioners, namely, Shree Kant Singh and Bikas Kumar Bikrant, in connection with Araria Police Station Case No. 317 of 2015, under Sections 465/466/467/468/474/406/471/420/34 of the Indian Penal Code.

Perused the above application and materials on record.

Heard Mr.Kaushal Kishor, learned Counsel for the petitioners, and Md. Arif, learned Additional Public Prosecutor, appearing on behalf of the State.

In view of the fact that the accused above-named

Patna High Court Cr.Misc. No.47056 of 2015 (2) dt.15-10-2015 2/3 have been in custody in this case since 3.7.015 in connection with the case aforementioned, though charge sheet has been submitted, trial has not yet commenced, and similarly situated co-accused have been granted bail by a Bench of this Court by the orders, dated 7.9.2015, 11.9.2015 and 29.9.2015, passed in Cr. Misc. No.

36079 of 2015, 40990 of 2015 and 45169 of 2015 respectively, and perusal of the materials available does not reveal such incriminating materials, which would warrant further detention of the accused-petitioners in custody, and in view also of the fact that the perusal of the materials does not reveal that the accused-petitioners' liberty on bail would adversely affect their trial, it is, in the interest of justice, hereby directed that the accused above-named shall be released on bail of Rs. 10,000/- with two sureties each, each of the like amount, subject to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Araria Police Station Case No. 317 of 2015.
