JUSTICE PRABHAT KUMAR JHA ORAL ORDER 24-09-2015 Heard the learned counsel for the petitioner, the learned counsel for the informant and the learned Additional Public Prosecutor.

The petitioner seeks bail in a case under Section 498A and other sections of the Indian Penal Code and under section 3⁄4 of Dowry Prohibition Act.

The petitioner is the husband and the wife has made allegation that petitioner demanded Rs. 10 lacs and a house and due to non-fulfillment assaulted her and her maternal uncle. It is submitted that wife of the petitioner does not want to live with the petitioner. The petitioner is ready to keep his wife.

Patna High Court Cr.Misc. No.44995 of 2015 (2) dt.24-09-2015 2/2 The learned counsel for the informant submits that the informant has reasonable apprehension of being killed and if the petitioner gives undertaking to keep her properly the informant is ready to live with him.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner has already remained in jail for more than one month, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar Bharti, learned Judicial Magistrate, Patna in Budha Colony P.S. Case No. 235 of 2014.
