The petitioner seeks bail in connection with Gaighat P.S. Case No. 256 of 2017 for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Amendment Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery has been made from gairmazarua open land and the petitioner has no concern
