1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Agiaon Bazar P.S. Case No. 32 of 2023 dated 24/02/2023 registered for the offence under Section 394 of the Indian Penal Code.
3. As per the First Information Report while the informant was going on a motorcycle with her husband and children, three miscreants intercepted them and tried to snatch gold chain from the neck of the informant. The second co-accused pushed the informant and her husband as a result of which informant along with her family members fell down. The third accused person resorted to firing also.
4. Dr. Kamal Deo Sharma, learned counsel appearing
Patna High Court CR. MISC. No.50228 of 2023(3) dt.01-11-2023 2/2 for the petitioner submits that petitioner is not named in the F.I.R. and has been made accused on the basis of confessional statement of the co-accused / Sachin Kumar. No incriminating article and / or looted article has been recovered from the possession of the petitioner.

Having heard learned counsel for the parties and taking into consideration the material on record including the fact that during investigation two accused persons namely, Sachin Kumar and Vikash Yadav were apprehended and from the person of Sachin Kumar a loaded country made pistol and a gold ring were recovered and he has confessed that petitioner was also involved in the commission of the present offence and the petitioner is having two criminal antecedent also, as such, I am not inclined to grant anticipatory bail to the petitioner.
