2. The petitioner seeks bail in connection with Sessions Trial No. 287A of 2020 arising out of Begusarai Town P.S. Case No. 613 of 2017 instituted for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 427, 379, 504 and 506 of the Indian Penal Code.

3. As per allegation in the FIR, all the co-accused persons including the petitioner assaulted the informant and his father by means of iron rod due to which they sustained grievous injuries.

4. Learned counsel for the petitioner submits that it is a case of misuse of bail and the petitioner is absented from the trial Court since long, so his bail bonds has been cancelled on

Patna High Court CR. MISC. No.49189 of 2026(2) dt.22-07-2026 2/3 05.06.2025. He submits that the petitioner was remanded in this case on 30.04.2026 from another case. He further submits that the petitioner was granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 23380 of 2018 vide order dated 19.04.2018.

He next submits that due to engage in agriculture work, he could not appear in the trial Court, so a representation under Section 317 of the Code of Criminal Procedure has been filed by his counsel and similar representation has also been filed by other co-accused persons including the petitioner and it also appears that the petitioner was not pressed the application by his counsel, so the bail bonds of six other co-accused persons including the petitioner were cancelled and non bailable warrant of arrest was issued against him. He lastly submits that the petitioner again moved before the trial Court on 04.05.2026 for grant of bail which was also rejected with an observation that the petitioner may reapply for grant of bail after 45 (forty five) days, which was also rejected.

In the aftermath of all these rejections of bail, he has moved before this Court for grant of bail. Petitioner is in custody since 30.04.2026.

5. Learned APP for the State opposes the prayer for regular bail of the petitioner.

6. Considering the submission of learned counsel for the petitioner and the above mentioned circumstances, I am inclined to grant regular bail to the above named petitioner.

7. Accordingly the prayer for regular bail of the above named petitioner is allowed. Let the petitioner above named be released on regular bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session's Judge-IInd, Begusarai in connection Sessions Trial No. 287A of 2020 arising out of Begusarai Town P.S. Case No. 613 of 2017.

8. The trial Court is directed to conclude the proceeding of framing of charge as per law within a period of one month from the date of receipt of a copy of this order. (Ramesh Chand Malviya, J) Anand Kr.
