This is a petition for grant of anticipatory bail for offence under Section 47 of the Excise Act.
From the house of this petitioner country made liquor was recovered by the authorities.
Considering the submission of the petitioner, above named, that he has got no criminal antecedent, the recovery was not made in his presence, he, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with G.O. Case No. 20 of 2011 to the satisfaction of the Subdivisional Judicial Magistrate, Biraul at Benipur, Darbhanga, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code. At the time of furnishing bail bond the petitioner shall file affidavit stating that he would not indulge in such activity.
