JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Muffasil P.S.Case No. 318 of 2017 registered under Sections 341, 354A, 427, 504 and 506 of the Indian penal Code and Section 18 of the Protection of Children from Sexual Offences Act, 2012 Allegation in brief is that informant, while returning back from coaching, was pushed by the petitioner and when she protested then abused and assaulted and also threatened her. Submission is that petitioner is also a co-villager and allegation is not true and he has clean antecedent and is in custody since 15.12.2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Diwakar Kumar @ Diwakar Paswan, is

Patna High Court Cr.Misc. No.9622 of 2018 (2) dt.17-02-2018 2/2 directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge-Cum-Additional Sessions Judge-1st, Munger, in connection with Mufassil P.S. Case No. 318 of 2017 with condition that one of the bailor must be his parents. Petitioner shall not make any inducement or threat to the prosecutrix or other witness or if he found involved in similar offence in future, his bail bond shall be liable to be cancelled.
