2. Petitioners seek regular bail in connection with Gopalganj Town P. S. Case No. 884 of 2023 in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.
3. It is alleged that on 07.11.2023, younger brother of the informant went to meet his friend but did not return. On search, his dead body was found lying in bamboo orchard of Mahadev Ram. Informant suspects that co-accused Nishu Kumari (with whom deceased had love affair) in collusion with other named accused killed the brother of informant.

Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. and their names transpired during course of investigation on the basis of confessional statement of co-accused. Petitioner no. 1 is father and petitioner no. 2 is brother of co-accused Nishu Kumari who has already been granted regular bail vide order dated 19.08.2024 passed in Cr. Misc. No. 23769 of 2024. Petitioners claim clean antecedent and are in custody since 28.02.2025. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of allegation, clean antecedent and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P. S. Case No. 884 of 2023.
