The petitioner seeks anticipatory bail in Town P.S.Case No.601 of 2017 instituted for the offence under Sections 147, 148, 149, 302, 379, 427, 452, 504 and 506 of the I.P.C. It has been submitted that considering the specific allegation of causing firearm injury by co-accused Anandi Pandey and Bhikhu Yadav the other F.I.R. named co-accused, namely Narain Srivastava and Rana Srivastava have been granted anticipatory bail by different coordinate Bench of this Court vide orders dated 17.02.2018 and 20.02.2018 passed in Cr.Misc.No.9425 of \2018 and Cr.Misc. No.8819 of 2018 respectively.

It appears that the deceased sustained only one firearm

Patna High Court Cr.Misc. No.10481 of 2018 (2) dt.27-02-2018 2/2 injury which is apparent from the post mortem report, annexed as Annexure-2 to this petition. The petitioner has clean antecedent and nothing is attributed to the petitioner.

Considering the facts and circumstances of the case, prayer for anticipatory bail to the petitioner is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Gopalganj, in Town P.S.Case No.601 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
