JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-07-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with CII Case No. 01 of 2021, registered for the offences punishable under Sections 33, 41, 42 of the Indian Forest Act, 1927 (Bihar Amendment Act 1989).
Some accused persons were loading trees after cutting from the forest. On raid a tractor loaded with wooden logs was recovered.
Learned counsel for the petitioner has submitted that, as per allegation, four accused persons became successful in fleeing away amongst whom two were identified in the torch light as co-
Patna High Court CR. MISC. No.59815 of 2021(2) dt.12-07-2022 2/2 accused Shravan Kumar and co-accused Abhishek Kumar. The petitioner has been implicated since he is owner of that tractor. He is a person of clean antecedents.
Considering the above-mentioned facts and circumstances, especially, the clean antecedents of the petitioner, let him, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with CII Case No. 01 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
