====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 19-08-2023 Heard learned Counsel for the petitioners and learned APP for the State.
2. The petitioners are apprehending their arrest in connection with Sherghati P.S. Case No.317 of 2023 dated 28.03.2023, lodged under Sections 341, 323, 354, 379, 504 & 506 of the Indian Penal Code.
3. As per prosecution case, the F.I.R. has been lodged against three named accused persons with allegation that they all visited at the shop of the informant and started abusing. Upon oppose, the accused persons assaulted the husband of informant and snatched money and chain thereafter fled away in the stage of intoxication.
4. Learned counsel for the petitioners submits that petitioners are innocent and have not committed any offence. He

No.52362 of 2023(2) dt.19-08-2023 2/2 further submits that the dispute has taken place as the petitioners are resident of the locality and use to oppose the informant for not keeping his thela in the mid of road but instead of removing thela, the informant has filed criminal case against the petitioner with a view to teach lesson. He also submits that the antecedents of petitioners are clean and the cause of dispute has already been explained by the counsel for the petitioners.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. In the present facts and circumstances, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati, in connection with Sherghati P. S. Case No.317 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dr. Anshuman, J.) Ritik/- U T
