ANJANA PRAKASH ORAL JUDGMENT Date: 08-02-2016 The Petitioner seeks revision of the judgment of conviction dated 29.6.2015 passed by the District and Sessions Judge, Purnea in Criminal Appeal No.05 of 2015 (R. No.04 of 2015), by which he has upheld the conviction of the Petitioner under the provisions of Arms Act and maintained the sentence of 2 years and six months R.I. u/s.25(1-B) of the Arms Act and further R.I. for two years with fine of Rs.1000/- u/s.26(1) of the Arms Act and in default of which simple imprisonment for another one month under each count, by a judgment dated 22.12.2014 passed by the court of Sri Prashant Kumar, J.M., 1st class, Purnea in connection with G.R. case No.1439 of 2011 arising out of K. Hat (Sahayak) P.S. case No.235 of 2011 (Trial Reg. No.2911 of 2014).

However, considering that the Petitioner has remained in custody for about nine months, the sentence is modified to the period already undergone by him. He is required to deposit a sum of Rs.4000/- as fine within a period of four weeks from the date of receipt of this order, failing which he shall undergo simple imprisonment for a term of six months more. With the aforesaid modification in sentence, the revision application stands dismissed.
