====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-07-2021 Heard Mr. Ghanshyam Tiwary, the learned Advocate for the petitioner and Mr. Ram Priya Sharan Singh, the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Phulwarisharif P. S. Case No.214 of 2020, instituted for the offences under Sections 147, 148, 323, 307, 504, 506, 337 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation against the petitioner is of having fired from his weapon which hit nobody. The pistol of petitioner was used for assaulting one of the injured persons of this case. The injuries suffered by one of the victims by the petitioner in this case is reported to be simple in nature.

Be that as it may, regard being had to the fact that

Patna High Court CR. MISC. No.2917 of 2021(2) dt.29-07-2021 2/2 there is an accusation that this occurrence took place because of the informant protesting against the raucous behaviour of the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail of the petitioner is rejected.

However, if the petitioner surrenders before the Court below and seeks bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
