The petitioner seeks bail in a case registered for the offences punishable under Sections 394 and 34 of the Indian Penal Code.

The petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of Indal Yadav. Save and except the confession of the co-accused no tangible material has been collected against the petitioner. The petitioner was not even put on test identification parade. Indal Yadav has already been enlarged on bail. Amresh Yadav @ Amresh Kumar has been enlarged on anticipatory bail. Considering the facts aforesaid and the fact that, of course, the petitioner has got criminal antecedent, but the
